Who will pay for the damage to my car?

Usually, whoever caused the crash pays for the repairs. If your car is “totaled,” you get the fair market value of the car. Your car is “totaled” when the cost of repairs is greater than its fair market value.

What factors determine the fair market value of my car?

To determine fair market value, cars by the same manufacturer, year, body style, options and mileage are considered. Other factors may include the overall body condition in terms of dents, rust and chipping paint. Recent repairs and installation of additional options increase the value of the car. Examples include replacing a transmission, installing a security system, and purchasing new tires. Find your paperwork and present a copy to the property damage claims adjuster for consideration. When possible, fair market value is based on similar cars within your local area.

My car is totaled. Do I have to pay anything to transfer the car title to the insurance company?

Once totaled, the fair market value is paid by the insurance company. In Ohio,the insurance company must also pay all applicable taxes, license fees, and any other fees that may come up to complete the process. If you are making a claim under your own insurance policy, you will have to pay the deductible.

Can I get a rental car?

You may be eligible for a rental car if your car is severely damaged. If your car is totaled, the amount of time you get to keep the rental becomes extremely limited. You are responsible for quickly finding a replacement or paying for the rental out of your own pocket.
